DUI DWI Car Accident
Have you been involved in a DUI/DWI car accident and need a DUI/DWI car accident attorney? Across the nation, the legal limit for Blood Alcohol Concentration (BAC) is .08 percent. However, BAC limits are usually lower for minors, typically .02 percent. Penalties vary from jurisdiction to jurisdiction, but one thing they all have in common is low tolerance for people involved in DUI/DWI car accidents. In some states, penalties get stiffer the more you are over the legal limit. For example: some states implement a penalty for being above .08 percent but the charge moves up one degree if your BAC is over .15 percent. Some states allow for similar convictions from other jurisdictions to be applied to your charge in that state so they may apply repeat offender charges and penalties.Penalties can include: mandatory incarceration, additional prison time if the violation occurred within certain parameters, vehicle towed and impounded, steep fines, suspension or revocation of your driver’s license, restricted driving privileges following the suspension, have an ignition interlock device installed in your vehicle, alcohol and/or drug abuse treatment program, probation, loss of commercial license, community service, attend/panel DUI/DWI victim impact seminars, submit to regular urine tests to check for traces of alcohol and/or drugs, and court costs and other fees. In addition, many states will charge you separately for each person hurt or killed in a DUI or DWI car accident. That can also apply if you are charged with driving while under the influence of any schedule I or II substance or if traces of their metabolites are found in your body. The U.S. Drug Enforcement Administration (DEA) determines and assigns the schedule of drugs or controlled substances. Schedule I or II substances include, but are not limited to: marijuana, hash, hash oil, LSD/Acid, Foxy, Opium, hydrocodone, OxyContin, Demerol, Morphine, Nexus/Bees/Venus, STP, methamphetamine, Amphetamines, Nembutal, Blue Mystic, Methadone, Heroin, Ecstasy, Ketoamphetamine, GHB, MDMA, Peyote, Mescaline, psychedelic mushrooms, or cocaine.
